What we handle in a divorce

The settlement divides what you own. We work out what each piece is worth after tax, alongside your attorney.

  1. 01

    Your filing status

Your status for the whole year follows your marital status on December 31. With a final decree by then you file single, or head of household if you qualify; still married and you generally file jointly or separately.

  2. 02

    Splitting a 401(k) or pension

A workplace plan is divided by a qualified domestic relations order (QDRO). Money the plan pays you as the former spouse under a QDRO avoids the 10% early withdrawal tax, though income tax still applies.

  3. 03

    Splitting an IRA

An IRA is divided by a transfer incident to divorce, which is not taxable and makes your share your own IRA. The QDRO exception does not reach IRAs, so withdrawals before 59½ can still owe the 10% tax.

  4. 04

    Alimony

For agreements signed after 2018, alimony is not deductible by the payer and not income to the recipient. An older agreement keeps the old treatment unless a modification expressly adopts the new rule.

  5. 05

    Who claims the children

The custodial parent claims a child by default. Form 8332 can release the child tax credit to the other parent, but not head of household status, the earned income credit or the dependent care credit.

  6. 06

    Beneficiaries and your new budget

Retirement accounts and life insurance pass by beneficiary form, outside your will, so an old form can still name your former spouse. Update them when your attorney confirms you can, and we rebuild your budget for one household.

How Nino helps during a divorce

Nino does not give legal advice or represent you. Your CPA and Financial Planner work alongside your attorney: they show what each proposed split is worth after tax, then rebuild your plan and file your returns once it is final.

  • Settlement offers, after tax

Your CPA compares proposals on what each asset is worth after tax, so a dollar in a traditional 401(k), a dollar of low-basis stock and a dollar of cash are not treated as equal.

  • A new plan in your first two weeks

Your financial planner builds a plan for one household from your new income, support payments and costs, then revisits it every quarter as the details become final.

  • Returns for the transition year

Your CPA prepares your federal and state returns for the year of the divorce and the years after, and files nothing until you approve it. Essential covers one person; Plus adds joint filing for a final year filed together.

Which settlement choices carry a tax bill?

Four choices to price before you sign, not when the first return is due.

The cost basis of what you keep

Property passes between spouses in a divorce with no gain or loss, and you take over its original basis. $500,000 of stock bought for $100,000 carries $400,000 of future taxable gain that $500,000 of cash does not.

Keeping or selling the home

A single owner can exclude up to $250,000 of gain after owning and living in the home 2 of the last 5 years. Ownership time of a spouse who transferred it to you counts as yours, and so does a former spouse’s use while the decree lets them live in a home you own.

Taking cash under the QDRO

A withdrawal paid straight from the plan under a QDRO avoids the 10% tax at any age. Roll the money to an IRA first and that exception is gone, so decide what you need in cash before the rollover.

Social Security on your former spouse’s record

If the marriage lasted at least 10 years and you are unmarried, you can claim from 62 on a former spouse’s record when that pays more than your own. A decree dated before the 10th anniversary loses that option.
